Returns Policy
General Terms and Conditions
- Definitions
In these Terms and Conditions:
(a) "7STORES.AU" refers to 7STORES.AU, ABN: 56682050371.
(b) "Australian Consumer Law" refers to the legislation outlined in Schedule 2 of the Competition and Consumer Act 2010.
(c) "Contract" means the agreement between 7STORES.AUand the Customer for the sale of goods and/or services incorporating these Terms and Conditions.
(d) "Consumer Contract" refers to an agreement where goods or services are purchased as a 'consumer' under section 3 of the Australian Consumer Law.
(e) "Customer" refers to the individual or business purchasing goods from 7STORES.AU, as specified in the Order, quotation, or Tax Invoice.
(f) "Goods" includes any products, accessories, spare parts, or services provided by 7STORES.AU to the Customer under these Terms and Conditions.
(g) "High Risk Activities" refer to hazardous environments requiring fail-safe performance (e.g., nuclear facilities, aircraft navigation, medical life support systems), where failure of the Goods could result in serious harm or damage.
(h) "Order" refers to the Customer's request for the purchase of Goods through the Website or other means (email, phone, facsimile, or in person).
(i) "Place of Delivery" refers to the delivery location specified by the Customer during the ordering process, and agreed upon by 7STORES.AU.
(j) "Premises" refers to the location occupied by 7STORES.AU, Melbourne, Vic, 3000.
(k) "Returns Policy" outlines the guidelines for returning Goods, as found on the Website.
(l) "Tax Invoice" refers to the invoice provided to the Customer upon order placement, to be paid prior to dispatch and delivery of the Goods.
(m) "Website" refers to the domain www.7STORES.AU, owned by 7STORES.AU. - Formation of Contract
2.1 A Contract is formed once the Customer’s Order is accepted by 7STORES.AU a Tax Invoice is issued and paid in full.
2.2 Goods sold by 7STORES.AU are subject to these Terms and Conditions, superseding any other terms stipulated by the Customer. Acceptance of the Goods by the Customer implies acceptance of these Terms. - Orders, Pricing, and Payment
3.1 Prices are subject to change without notice and can be adjusted before acceptance.
3.2 If prices increase after payment but before dispatch, 7STORES.AU may request the difference. Customers may cancel the order within seven (7) days of being notified of a price increase.
3.3 Full payment must be made before dispatch, as per the Tax Invoice’s payment terms.
3.4 Payment methods accepted include direct deposit, internet transfer, PayPal, and credit cards. Credit card payments incur surcharges (1.5% for VISA/MASTERCARD, 3% for AMEX, 2.5% for PayPal).
3.5 Shipping and handling charges are payable by the Customer and included in the Tax Invoice.
3.6 The Customer is responsible for all applicable taxes and duties. If GST applies, an additional amount is payable by the Customer at the time of payment.
3.7 Time for payment is essential. Failure to pay within seven (7) days may result in the order being cancelled. - Cancellation and Returns
4.1 Orders may be cancelled before dispatch by providing written notice. A cancellation fee of 20% of the Order value applies.
4.2 Goods can be returned if faulty, defective, not fit for purpose, or of unacceptable quality, in accordance with the Returns Policy. Change-of-mind returns are allowed within ten (10) days of delivery if the product is unopened and in its original condition. - Software
5.1 Software provided is subject to the license agreement accompanying it, which the Customer agrees to follow.
5.2 Intellectual property rights in software remain with the licensor. - Title and Risk
6.1 Title and risk pass to the Customer upon delivery. Title for software remains with the licensor.
6.2 If credit terms are granted, title remains with 7STORES.AU until payment is received in full. Until then, the Customer holds the Goods in trust for 7STORES.AU. - Delivery
7.1 7STORES.AU aims to deliver Goods within 3-7 business days but does not guarantee these times.
7.2 If delivery is delayed beyond a reasonable time, the Customer may cancel the Order.
7.3 Goods can only be accepted by the Customer or an authorised person with ID. Additional charges may apply for re-delivery. - Acceptance of Goods
8.1 Goods are deemed accepted unless 7STORES.AU is notified of any issues within three (3) days of delivery. - Warranty
9.1 7STORES.AU complies with warranties required by Australian Consumer Law.
9.2 Manufacturer warranties apply from the date of the Tax Invoice.
9.3 Warranty claims require proof of purchase. - Liability
10.1 7STORES.AU is not liable for losses beyond those outlined in Australian Consumer Law.
10.4 7STORES.AU`s liability is limited to the replacement, repair, or refund of Goods as per Australian Consumer Law.
