General Terms and Conditions
- Definitions
In these Terms and Conditions:
(a) "7STORES.AU" refers to 7STORES.AU, ABN: 56682050371.
(b) "Australian Consumer Law" refers to the legislation outlined in Schedule 2 of the Competition and Consumer Act 2010.
(c) "Contract" means the agreement between 7STORES.AU and the Customer for the purchase of Goods and/or services, which incorporates these Terms and Conditions.
(d) "Consumer Contract" refers to an agreement for the acquisition of goods or services as a 'consumer' under section 3 of the Australian Consumer Law.
(e) "Customer" refers to the person or business purchasing Goods from 7STORES.AU, as indicated in the Order, quotation, or Tax Invoice provided.
(f) "Goods" includes all products, accessories, materials, spare parts, and services supplied by 7STORES.AU to the Customer.
(g) "High Risk Activities" refers to using Goods in environments requiring fail-safe performance, such as in nuclear facilities, aircraft navigation, life-support systems, or other critical applications where failure could result in severe harm or damage.
(h) "Order" refers to the Customer's request for Goods made via the Website, email, phone, or other communication methods.
(i) "Place of Delivery" refers to the delivery location provided by the Customer and agreed upon by 7STORES.AU.
(j) "Premises" refers to the location of 7STORES.AU, Melbourne, Victoria, 3000.
(k) "Returns Policy" refers to the product returns policy listed on the Website.
(l) "Tax Invoice" refers to the invoice provided to the Customer after an Order is placed, indicating the payment required.
(m) "Website" refers to the www.7STORES.AU domain, owned by 7STORES.AU.
- Formation of Contract
2.1 A Contract is established between 7STORES.AU and the Customer when an Order is accepted, a Tax Invoice is issued, and full payment is received. The Customer affirms that purchases are for personal use and not for resale.
2.2 All Goods sold by 7STORES.AU are subject to these Terms and Conditions, superseding any other terms provided by the Customer. By accepting the Goods, the Customer agrees to these Terms. Any conflicting terms from the Customer are not accepted unless expressly agreed upon by 7STORES.AU - Orders, Pricing, and Payment
3.1 Prices quoted by 7STORES.AU are subject to change and may be revised before an Order is accepted.
3.2 If prices increase after an Order is placed but before dispatch, 7STORES.AU may request additional payment. The Customer may cancel the Order within seven (7) days of being notified of the price change.
3.3 Full payment for Goods is required before dispatch, as per the terms outlined in the Tax Invoice.
3.4 Payment methods accepted include direct deposit, internet transfer, PayPal, and credit cards. Surcharges for credit cards are as follows: VISA/MASTERCARD (1.5%), AMEX (3%), PayPal (2.5%).
3.5 The Customer is responsible for all applicable shipping and handling charges, disclosed at the time of Order placement.
3.6 The Customer agrees to cover all applicable taxes, duties, and import costs. If GST applies, it will be added to the total order amount.
3.7 If payment is not received within fourteen (14) days of the Tax Invoice, 7STORES.AU reserves the right to cancel the Order. - Cancellation and Returns
4.1 Cancellation requests prior to delivery must be submitted in writing and may incur a 20% cancellation fee.
4.2 Returns for change of mind or faulty Goods are subject to the Returns Policy. Goods must be returned in their original packaging and in sellable condition. - Software
5.1 Software is provided under its respective license agreement. The Customer agrees to abide by the terms of these licenses.
5.2 Intellectual property rights in software remain with the licensor. - Title and Risk
6.1 Title and risk in the Goods pass to the Customer upon delivery, except for software, which remains the property of the licensor.
6.2 If deferred payment terms are agreed upon, title remains with 7STORES.AU until full payment is received. - Delivery
7.1 7STORES.AU aims to deliver Goods within three (3) to seven (7) business days following full payment, though actual delivery times may vary based on location and parts availability.
7.2 The Customer may cancel the Order if delivery is unreasonably delayed.
7.3 Delivery must be accepted by the Customer or an authorized representative, with photo ID required at the time of delivery.
7.4 7STORES.AU is not liable for loss or damage during delivery, but will assist the Customer with carrier claims if notified promptly. - Acceptance of Goods
8.1 Goods are considered accepted unless the Customer notifies 7STORES.AU of any issues within three (3) days of delivery.
8.2 This clause does not affect the Customer's rights under Australian Consumer Law. - Warranty
9.1 Nothing in these Terms excludes any rights under Australian Consumer Law.
9.2 Manufacturer warranties apply to all Goods. The Customer should review warranty documents provided with the Goods.
9.3 Proof of purchase is required for warranty claims. - Liability
10.1 7STORES.AU’s liability is limited to the extent permitted by Australian Consumer Law.
10.2 For non-consumer contracts, liability is limited to the total price of the Goods purchased.
10.3 The Customer agrees to indemnify 7STORES.AU against any losses resulting from negligence or breach of contract.
10.4 7STORES.AU will not be liable for any incidental, indirect, or consequential damages. - Use of Goods
11.1 Goods are designed for specific purposes, and misuse may affect the Customer’s rights.
11.2 The Customer agrees to use the Goods in accordance with operating instructions and specified conditions.
11.3 Goods are not intended for High Risk Activities, and 7STORES.AU disclaims any warranty of fitness for such uses. - Force Majeure
12.1 Neither party will be held liable for delays caused by circumstances beyond their reasonable control. - Governing Law
13.1 These Terms are governed by the laws of Victoria and are subject to the jurisdiction of the courts of Victoria. - General
14.1 Contracts may not be assigned without written consent from 7STORES.AU.
14.2 If any provision is deemed invalid, the remaining Terms remain in effect.
14.3 Failure to enforce any right does not waive the right to future enforcement.
